198. RESOLUTION NO. 2005--1.1.LR A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO.1 TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY, HAYS COUNTY AND THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR FUNDING FOR IMPROVEMENTS TO OLD BASTROP ROAD; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND DECLARING AN EFFECTNE DATE. RECITALS: 1. The City of San Marcos (the "City"), the County of Hays (the "County"), and the San Marcos Consolidated Independent School District ("SMCISD") entered into an Interlocal Agreement for Roadway Construction dated September 30,2004 (the "Interlocal Agreement") to cooperate in the process of designing and constructing various roadway improvements, including a project for improvements to the intersection of State Highway 123 and Old Bastrop Road (County Road 266) (the "Intersection Improvements Project"). 2. The estimated cost of the Intersection Improvements Project has increased, and the Texas Department of Transportation ("TXDOT") has requested the City to execute an Advance Funding Agreement regarding the costs for the Intersection Improvements Project to be borne by the City, the COlmty and SMCISD under the Interlocal Agreement. 3. The City Council wishes to approve an amendment to the Interlocal Agreement to revise the contributions to be made by each of the parties to the cost of the Intersection Improvements Project. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Amendment No.1 to Interlocal Agreement for Roadway Construction between the City of San Marcos, Hays County and the San Marcos Consolidated Independent School District is approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the agreement on behalf of the City. PART 3. This Resolution is in full force and effect immediately from and after its adoption.
