<br />1 Comments in Favor of the Proposed Restriction <br /> <br />2 The department received a total of sixteen comments favorable to the proposed lane restriction. <br /> <br />3 In general, these commenters believe that the proposal will lead to increased safety and improved <br /> <br />4 mobility. <br />5 Several of these favorable commenters suggested that speed limits should be more rigorously <br /> <br /> <br />6 enforced, that speed limits for large trucks should be lower than that for passenger vehicles, that <br /> <br /> <br />7 speed limits should only be established using strict engineering criteria, that the state maximum <br /> <br /> <br />8 prima facie speed limit of 70 miles per hour should only be used after a thorough study, and that <br /> <br />9 the department also consider the use of high-occupancy vehicle lanes and ramp entry signals. <br /> <br />10 Response <br /> <br />11 The department agrees that speed limits should be created only after the completion of an <br /> <br />12 engineering and traffic study. The department uses this approach when establishing speed limits. <br /> <br />13 Enforcement of speed limits is beyond the purview of the department and we recommend that <br /> <br />14 the commenter discuss these concerns with the appropriate law enforcement agencies. <br /> <br />15 The department agrees that the use ofROV lanes and technologies such as ramp metering have <br /> <br />16 beneficial impacts on mobility and are using these approaches as appropriate. <br />17 <br /> <br /> <br />18 Comments Opposed to the Proposed Restriction <br /> <br /> <br />19 The department received fifteen comments either in writing or during the March 4th public <br /> <br /> <br />20 hearing that were critical of the proposal. <br /> <br />21 <br /> <br /> <br />22 Comment: The Texas Motor Transportation Association (TMTA) commented that the proposed <br /> <br />23 24-hour, seven-days-a-week duration of the restriction is unnecessary and overly broad. <br /> <br />Page 2 of7 <br /> <br />27-May-04 <br /> <br />Exhibit A <br />
