184. RESOLUTION NO. 2005-jQL R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONSOFASER~CECONTRACTFORWASTEWATER TREATMENT FACILITIES OPERATIONS AND MAINTENANCE BETWEEN THE CITY AND OPERATIONS MANAGEMENT, INe.; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEIvIENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City has determined that it is in the City's best interests to contract with a third-party operator on a long-term basis to operate and maintain '.')ertain wastev.rater treatment facilities assets and to meet the requirements of applicable law. 2. The City issued a request for proposals on January 11, 2004 to certain firms to provide wastewater treatment facilities operations, and set forth in the RFP the criteria for selection of the preferred proponent. Four addenda to the RFP were issued on February 20,2004, February 23,2004, February 26, 2004 and March 3, 2004. 3. Proposals submitted in response to the RFP were received on March 1],2004. 4. A Request for Clarification was issued on September 21,2004. Three addenda to the Request for Clarification were issued on October 5,2004, November 1, 2004 and November 15, 2004, respectively. Proposal clarification submittals were received on November 29,2004. 5. Based on an evaluation utilizing the evaluation factors and selection criteria and following the review and selection process identified in the RFP, the City selected the proposal submitted by Operations Management, Inc. as the most advantageous proposal received in response to the City's RFP with respect to wastewater treatment facilities operations. 6. In March 2005, the City initiated the contract negotiations with Operations Management, Inc. which have concluded with the Service Contract for Wastewater Treatment Facilities Operations and Maintenance attached to this Resolution. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The terms and conditions of the attached Service Contract for Wastewater Treatment Facilities Operations and Maintenance between the City of San Marcos and Operations Management, hlc. is approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the agreement on behalf of the City.
