<br />City of San Marcos <br /> <br />TPDES Permit No. WQOO 1 0273002 <br /> <br />g. The approved program shall not be modified by the permittee without the prior approval of the <br />TCEQ Storm Water & Pretreatment Team (MC 148) of the Water Quality Division. <br /> <br />2. The permittee shall establish and enforce specific local limits to implement the provisions of 40 CFR <br />g403.5. For each POTW with an approyed pretreatment program, the permittee shall continue to develop <br />and enforce local limits as necessary. Additionally, for each POTW with an approved pretreatment <br />program, the permittee shall modify its pretreatment program, including the Legal Authority, Enforcement <br />Response Plan and/or Standard Operating Procedures, if required by the Executive Director to reflect <br />changing conditions at the POTW. Substantial modifications will be approyed in accordance with 40 CFR <br />~403.18 and the modification will become effectiye upon approval by the Executiye Director in accordance <br />with 40 CFR S403 .18. <br /> <br />Upon approyal by the Executive Director of the substantial modification to this approved POTW <br />pretreatment program, the requirement to develop and enforce specific prohibitions and/or limits to <br />implement the prohibitions and limits set forth in 40 CFR S~403.5 (a)(l), (b), (c)(l) and (3), and (d) is a <br />condition of this pennit. The specific prohibitions set out in 40 CFR ~403.5(b) shall be enforced by the <br />permittee unless modified under this provision. <br /> <br />3. The permittee shall analyze the treatment facility influent and effluent for the presence of the toxic <br />pollutants listed in the Texas Surface Water Quality Standards [30 TAC Chapter 307], and in 40 CFR Part <br />122 Appendix D (TPDES Application Testing Requirements) Table II at least once per year and the toxic <br />pollutants in Table III at least once per three months. If, based upon information available to the <br />permittee, there is reason to suspect the presence of any toxic or hazardous pollutant listed in 40 CFR Part <br />122 Appendix D Table V, or any other pollutant, known or suspected to adyersely affect treatment plant <br />operation, receiYing water quality, or solids disposal procedures, analysis for those pollutants shall be <br />performed at least once per three months on both the influent and the effluent. <br /> <br />The influent and effluent samples collected shall be composite samples consisting of at least 12 aliquots <br />collected at approximately equal intervals over a representatiye 24 hour period and composited according <br />to flow. Sampling and analytical procedures shall be in accordance with guidelines established in 40 CFR <br />Part 136. The effluent samples shall be analyzed to the minimum analytical leyel (MAL). Where <br />composite samples are inappropriate, due to sampling, holding time, or analytical constraints, at least four <br />(4) grab samples, taken at equal intervals over a representative 24 hour period, shall be taken. <br /> <br />4. The permittee shall prepare annually a list of IUs which during the preceding twelye (12) months were <br />in significant noncompliance with applicable pretreatment requirements. For the purposes of this section <br />of the permit, "CONTRIBUTING INDUSTRIES AND PRETREATMENT REQUIREMENTS", <br />significant noncompliance (SNC) shall be determined based upon the more stringent of either criteria <br />established at 40 CFR ~403.8(f)(2)(Yii) [rey. 7/24/90] or criteria established in the approved POTW <br />pretreatment program. This list is to be published annually in September in the largest daily newspaper <br />in the municipality in which the POTW is located. <br /> <br />In addition, each September the permittee shall submit an updated pretreatment program status report to <br />the TCEQ Storm Water & Pretreatment Team of the Water Quality Division containing the following <br />information: <br /> <br />a.
