<br />The City of San Marcos Facilities Service Contract <br /> <br />environmental media anywhere in, on or under the Facilities (including the presence in surface <br />water, groundwater, soils or subsurface strata) as of the Contract Date. <br />"Preventive Maintenance" means those repetitive, routine or scheduled activities <br />required or recommended by the Contract Standards, to maximize the service life of equipment, <br />vehicles and other components of the Facilities. <br />"Prime Rate" means the prime rate as published in The Wall Street Journal <br />(Eastem Edition), or a mutually agreeable alternative source of the prime rate if it is no longer <br />published in The Wall Street Journal (Eastem Edition) or the method of computation thereof is <br />su bstantially modified. <br />"Reference Documents" means the documents identified as such in the Table of <br /> <br />Contents. <br /> <br />"Regulated Substance" means (1) any oil, petroleum or petroleum product and <br />(2) any pollutant, contaminant, toxic substance, toxic pollutant, solid waste, municipal waste, <br />or industrial waste that is defmed as such by and is subject to regulation under any Applicable <br />Law. <br /> <br />"Renewal Term" has the meaning specified in Section 3.1. <br />"Repairs Costs" means the cost of those non-routine or non-repetitive activities <br />required for operational continuity, safety, and performance generally resulting from the failure <br />or to avert a failure of the equipment, sewer, vehicle, or the Facilities or come component <br />thereof. <br /> <br />"Required Insurance" has the meaning specified in Appendix 9. <br />"Residuals" means any solid, semi-solid, liquid residue or sludge removed during <br />the treatment of Influent or Trucked-in-Material at the Facilities. Influent and Effluent shall <br />not constitute Residuals. <br />"Residuals Element" means that portion of the Service Fee which relates to the <br />disposal of sludge from the Facilities. <br />"Residuals Guarantee" has the meaning set forth in Section 8.4. <br />"Residuals Management Services" means the On-Site Residuals Handling <br />Obligation and the Off-Site Residuals Disposal Obligations. <br />"Re-Use Effluent" means that Effluent which has been treated to a level <br />sufficient for re-use for certain purposes. <br />"Routine Maintenance" means ordinary and usual maintenance and care of <br />grounds, buildings, fencing, lighting, roadways, walkways, support systems and other general <br />maintenance activities, including but not limited to, mowing, leaf raking, trimming, cleaning, <br />spot painting, janitorial duties, snow removal, trash removal, spot seeding, replacing <br />landscaping bushes and flowers, and cleaning of walls, windows and piping. <br /> <br />12 <br />
