with temporary working space for initial construction of improvements, <br />from and along the entire length of the southeastern boundary line of the <br />CRC Site parallel to the Union Pacific Railroad right -of -way (the "UPRR <br />Easement ") and along the entire length of the northeastern boundary of <br />the CRC Site parallel with McCarty Lane (the "McCarty Easement "); <br />5: Construct as part of the CRC project a gravity wastewater pipeline, a <br />minimum of eight inches in diameter, manholes and associated facilities, <br />appurtenances and equipment and a water pipeline a minimum of 12 <br />inches In diameter and any associated facilities, appurtenances and <br />equipment as follows: <br />a. A wastewater pipeline, approximately 2,140 feet long (860' off- <br />site and 1280' across the CRC Site) beginning within the Off -Site <br />Easement (defined below) from an existing manhole on the <br />McCarty wastewater pipeline near the UPRR right -of -way and <br />the corner of the Pendergast and Neuhaus properties within the <br />easement area shown on Exhibit "B ", continuing under McCarty <br />Lane and through the CRC Site within the UPRR Easement to <br />the southwest boundary of the CRC Site a point in the eastern <br />corner' < ®f the CRC Site as illustrated on Exhibit "A", as Section 1; <br />and <br />b. A water pipeline, approximately 980 feet long within the McCarty <br />Easement from the end of an existing line near the corner of <br />Hunter Road and McCarty Lane to the boundary of the CRC Site <br />near the intersection of McCarty Lane with the UPRR railroad as <br />shown on Exhibit "A" as Section 2. <br />It is understood and agreed that the pipelines shall be installed on <br />alignments within the respective easements to provide proper separation <br />of systems and in accordance with specifications as approved by the <br />City. <br />6. Coordinate with the City regarding the specifications for the water and <br />wastewater facilities and obtain the City's approval of such specifications <br />and the estimated costs associated with the construction of such facilities <br />before soliciting bids for or constructing such facilities. The costs <br />attributed to construction of the water and wastewater facilities in any <br />contract for construction awarded by Texas State shall not exceed the <br />estimated amounts therefor approved by the City. Upon the award of <br />any such contract, Texas State will provide a copy of such contract to the <br />City. Texas State shall not authorize any change orders that increase <br />the costs of the water and wastewater facilities paid by the City without <br />the prior approval of the City. <br />61 Grant- access -to the City -to- inspect the water and-wastewater facilities <br />during and after construction for compliance with the City's <br />specifications. <br />Upon completion of the foregoing water and wastewater facilities <br />constructed by Texas State, dedicate to the City such facilities subject to <br />the City's acceptance as provided in subsection (b)(3). <br />2 1 P a g e <br />
