Mr. O'Leary stated the State Legislatur recently adopted new standards for the local government developmen application. He stated this new legislation established new timelines fo reviewing application for completeness, and if the applicant is not notified within a specific time frame regarding application deficiencies, then the application is deemed complete. Mr. Taylor inquired how this legislation will impact the citizens. Mr. Mark Taylor stated the Land Development Code provides specific timelines for completeness review and determination of deficiencies. He stated these timelines must be amended to reflect the new State Legislation. He stated the timeline occurs when the application is delivered to the Planning Department. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Narvaiz introduced for consideration a public hearing and approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CHANGING THE NAME OF SMITH AVENUE, FROM ITS INTERSECTION WITH MOORE STREET TO ITS INTERSECTION WITH RANCH ROAD 12, TO OSCAR SMITH STREET; AND INCLUDING PROCEDURAL PROVISIONS. Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mayor Narvaiz introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SETTING THE TAX RATE FOR THE 2005 TAX YEAR; LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2005, AND ENDING SEPTEMBER 30, 2006; PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE CITY; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. Mr. Mihalkanin moved for adoption of the Ordinance on emergency, and Mr. Taylor seconded the motion, which passed unanimously.
