<br />12. <br /> <br />Regular Meeting <br /> <br />September 6, 2005 <br /> <br />Page 12 <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on I <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER 2 OF THE CITY CODE TO <br />CHANGE THE NAME OF THE "MINORITY ECONOMIC AND TOURISM DEVELOPMENT <br />BOARD" TO THE "MINORITY TOURISM DEVELOPMENT BOARD"; AMENDING THE <br />COMPOSITION OF THIS BOARD; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Thomaides moved for approval of the Ordinance on first reading, and Mr. <br />Guerrero seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced a discussion regarding utility box screening as <br />required by the Land Development Code. Mr. O'Leary stated Staff met with <br />representatives from Time Warner and Grande Communication to discuss the <br />screening requirements in the Land Development Code. He stated the two <br />approaches for two circumstances provided in the Council packets were <br />discussed. Mr. Taylor stated if no other City has screening requirements, <br />then he is not interested in pressuring. Mr. Thomaides inquired if a <br />homeowner wants to plant vegetation and take care of the vegetation, would <br />that be permitted. Mr. O'Leary stated he feels this can be worked out. <br />The Council agreed by consensus to send the utility box screening I <br />requirement of the Land Development Code back to the Planning and Zoning <br />Commission for review. <br /> <br />Mayor Narvaiz introduced a discussion regarding City Council direction on <br />future agenda items. 1) Mr. Mihalkanin stated due to the Christmas <br />Holidays, he would like the Council to consider changing the 2nd Regular <br />Meeting in December. <br /> <br />Mayor Narvaiz introduced continuing Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation, a settlement offer, <br />or a matter involving attorney-client privilege (SMCISD construction <br />waivers); and Sections 551.072 and 551.073, to discuss the purchase of real <br />property (Bastrop Highway area; Hopkins Street area). The Council <br />adjourned into Executive Session at 10:25 p.m. <br /> <br />Mayor Narvaiz announced the Council would reconvene at 10:50 p.m. <br /> <br />Mayor Narvaiz introduced for consideration adoption or direction to Staff <br />on matters discussed in Executive Session. Mr. O'Leary stated Council <br />provided direction regarding the purchase of property on Bastrop Highwal <br />area. He stated Council also provided direction regarding the purchase 0 <br />easement property of Hopkins. Mr. O'Leary stated Council provide <br />direction on the relationship with the School Board on development issues. <br />
