<br />29. <br /> <br />RESOLUTION NO. 2005-~R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS URGING THE NATIONAL LEAGUE <br />OF CITIES TO OPPOSE FEDERAL ACTIONS THAT WOULD <br />DETRIMENTALLY AFFECT CITIES; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. WHEREAS, recent trends continue to indicate that the population of the United States is <br />becoming increasingly urbanized, and this increasing urbanization presents challenges to American <br />cities in terms of public safety, planning, transportation, utilities and other municipal services, and <br />the revenues and legal authority needed to provide these services; and <br /> <br />2. WHEREAS, the cities of America, to respond to these challenges in a prudent and <br />responsible manner, must have the legal authority to respond to the challenges effectively, and must <br />not have unfunded mandates imposed on them at the Federal level that drain local tax revenues; and <br /> <br />3. WHEREAS, the National League of Cities has traditionally been the principal advocate <br />for the interests of cities in the Federal government, and the City COlUlcil wishes to seek the <br />assistance of the National League of Cities on behalf of all cities in America to oppose any Federal <br />actions that would detrimentally affect the ability of cities to respond to the challenges facing them; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City of San Marcos, Texas urges the National League of Cities to work <br />vigorously to oppose any proposed Federal legislation, administrative regulations, or budgetary or <br />funding actions that would detrimentally affect the ability of American cities to respond to the <br />challenges facing them, especially legislation that would: <br /> <br />A. Create new obligations on the part of cities without the necessary funding to carry out the <br />obligations; or <br /> <br />B. Limit or remove the rights of cities to control land uses, businesses, development, or <br />environmental impacts that affect their lands or citizens; or <br /> <br />C. Create exemptions for other governmental agencies, special districts, or other political <br />subdivisions that would allow the imposition of projects, programs, or developments without <br />first obtaining permission of the local city in which such actions are proposed; or <br />
