<br />30. <br /> <br />RESOLUTION NO. 2005- 1 20 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AUTHORIZING PARTICIPATION BY <br />THE CITY IN A COALITION OF CITIES AND IN THE TX <br />LED COALITION TO TAKE POSITIONS BEFORE <br />REGULATORY AGENCIES AND COURTS RELATED TO <br />THE TEXAS LOW EMISSION DIESEL FUEL RULES; <br />AUTHORIZING EMPLOYMENT OF LEGAL COUNSEL; <br />AUTHORIZING CONTRIBUTION TOWARD LEGAL FEES <br />AND COALITION EXPENSES; AND DECLARING AN <br />EFFECTIVE DATE <br /> <br />RECITALS: <br /> <br />1. WHEREAS, diesel fuel rules are undergoing continual and substantial change as a <br />result of changes to state and federal statutes and administrative regulations; and <br /> <br />2. WHEREAS, certain proposed changes to diesel fuel rules could hinder or preclude the <br />City's use of diesel fuel and impose new and significant costs upon the City; and <br /> <br />3. WHEREAS, there is a need for potentially adversely affected cities and private parties <br />to cooperate to assure their common interests are protected in the consideration of diesel fuel <br />rules; and <br /> <br />4. WHEREAS, the "TX LED Coalition" was created in October 2004 to focus the <br />participation of large users of diesel fuel in the Texas State agency rulemaking process; and <br /> <br />5. WHEREAS, city end-users of diesel fuel have interests similar to those of current <br />members of the TX LED Coalition; and <br /> <br />6. WHEREAS, the Austin law firm of Lloyd Gosselink Blevins Rochelle & Townsend, <br />P.C. has expertise in environmental regulation, administrative law, and representation of <br />coalitions of cities, and currently serves as legal counsel to the TX LED Coalition; and <br /> <br />7. WHEREAS, it is reasonable to contribute 10 cents per capita based upon the most <br />recent TML population statistics, up to a cap of $1,000, towards legal and other TX LED <br />Coalition expenses; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City is authorized to participate with other similarly situated cities in <br />creating a coalition of cities (the "Cities Coalition") to address the Texas Low Emission Diesel <br />Fuel Rules (30 TAC Chapter 114) before agencies and courts. <br />
