<br />37. <br /> <br />RESOLUTION NO. 2005- 124 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AND ADOPTING A NEW GENERAL <br />PREVAILING WAGE RATE SCHEDULE FOR CONTRACTS FOR CITY <br />BUILDING CONSTRUCTION PROJECTS; REPEALING ALL <br />PREVIOUSLY ADOPTED PREVAILING WAGE RATE SCHEDULES; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECtT ALS: <br /> <br />1. Section 2258.022(a) of the Texas Government Code, requires that for a <br />contract for a public work awarded by the City, the City shall determine the general <br />prevailing rate of per diem wages in the locality in which the public work is to be performed <br />for each craft or type of worker needed to execute the contract and the prevailing rate for <br />legal holiday and overtime work. <br /> <br />2. Pursuant to Section 2258 .022( a)( 1) of the Texas Government Code, the City <br />can make the required wage rate determination by conducting a survey of the wages <br />received by classes or workers employed on projects of a character similar to the contract <br />work in the City in which the public work is to be performed, or by using the prevailing wage <br />rate as determined by the United States Department of Labor in accordance with the <br />Davis-Bacon Act (40 U.S.C. Section 276a et. seq.) and its subsequent amendments, ifthe <br />survey used to determine that rate was conducted within a three-year period preceeding <br />the date the public body calls for bids for the public work. <br /> <br />3. The City previously adopted prevailing wage rates in 1991 and again in 1994. <br /> <br />4. City staff conducted a new wage rate survey in January of 2005 and <br />recommends the adoption of the City of San Marcos Prevailing Wage Rate Schedule for <br />Building Construction (Exhibit B). <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The wage rate schedules previously adopted by the City Council are <br />repealed. <br /> <br />PART 2. The attached City of San Marcos General Prevailing Wage Rate Schedule <br />for Building Construction (Exhibit B) is approved and adopted for use on City building <br />construction projects. <br /> <br />PART 3. This Resolution shall be in full force and effect immediately from and after <br />its passage. <br /> <br />ADOPTED this 6th day of September 2005. <br />
