37. RESOLUTION NO. 2005- 124 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AND ADOPTING A NEW GENERAL PREVAILING WAGE RATE SCHEDULE FOR CONTRACTS FOR CITY BUILDING CONSTRUCTION PROJECTS; REPEALING ALL PREVIOUSLY ADOPTED PREVAILING WAGE RATE SCHEDULES; AND DECLARING AN EFFECTIVE DATE. RECtT ALS: 1. Section 2258.022(a) of the Texas Government Code, requires that for a contract for a public work awarded by the City, the City shall determine the general prevailing rate of per diem wages in the locality in which the public work is to be performed for each craft or type of worker needed to execute the contract and the prevailing rate for legal holiday and overtime work. 2. Pursuant to Section 2258 .022( a)( 1) of the Texas Government Code, the City can make the required wage rate determination by conducting a survey of the wages received by classes or workers employed on projects of a character similar to the contract work in the City in which the public work is to be performed, or by using the prevailing wage rate as determined by the United States Department of Labor in accordance with the Davis-Bacon Act (40 U.S.C. Section 276a et. seq.) and its subsequent amendments, ifthe survey used to determine that rate was conducted within a three-year period preceeding the date the public body calls for bids for the public work. 3. The City previously adopted prevailing wage rates in 1991 and again in 1994. 4. City staff conducted a new wage rate survey in January of 2005 and recommends the adoption of the City of San Marcos Prevailing Wage Rate Schedule for Building Construction (Exhibit B). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The wage rate schedules previously adopted by the City Council are repealed. PART 2. The attached City of San Marcos General Prevailing Wage Rate Schedule for Building Construction (Exhibit B) is approved and adopted for use on City building construction projects. PART 3. This Resolution shall be in full force and effect immediately from and after its passage. ADOPTED this 6th day of September 2005.
