ORDINANCE 2005- 68 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REPEALING SECTIONS 38.026 AND 38.027 OF THE CITY CODE AND AMENDING SECTION 38.028 OF THE CITY CODE TO TRANSFER THE FIRE MARSHAL'S OFFICE TO BE A DIVISION OF THE MARSHAL'S DEPARTMENT; AMENDING CHAPTER 62, PUBLIC SAFETY, OF THE CITY CODE TO CREATE THE MARSHAL'S DEPARTMENT, WITH A FIRE MARSHAL DIVISION AND A CODE ENFORCEMENT DIVISION; AUTHORIZING THE MARSHAL'S DEPARTMENT TO ENFORCE ALL CITY CODES AND ORDINANCES; AND INCLUDING PROCEDURAL PROVISIONS RECITALS: 1. The City Council approved a budget amendment ordinance to provide funding for the creation of a department devoted to code enforcement. 2. The City Council wishes to name the newly created code enforcement department the "Marshal's Department". 3. The City Council wishes to transfer the duties and reporting responsibility of the Fire Marshal from the Fire and Rescue Department to the newly created Marshal's Department. 4. The City Council wishes to authorize the code enforcement officers employed by the Marshal's Department to enforce all City codes and ordinances. 5. The City Council wishes to authorize the Director of the Marshal's Department to appoint licensed peace officers as needed for code enforcement purposes. 6. Amendments to the City Code are needed to implement these changes. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Sections 38.026 and 38.027 of the San Marcos City Code are repealed, and Section 38.028 of the San Marcos City Code is amended as follows (underlininQ indicates added text, strikethrough indicates deleted text): Sec. 38.027.
