officer is authorized to issue citations to any person he or she has probable cause to believe is in violation of any provision of this code, including the land development code, building and construction codes, fire code and health codes to the extent authorized or restricted by state law. Sec. 62.503. Right of entry; judicial warrant (a) The code enforcement officers are entitled to enter any building or premises at any reasonable time if they have a reasonable basis for believing that one or more violations of this code exist at the building or premises. (b) If the owner, occupant or person in control of the refuses to consent to entry or is not available to provide consent, the code enforcement officer may apply to a court of competent jurisdiction for warrants, writs or orders necessary to enforce this section, and the court may grant appropriate relief. A code enforcement officer is not required to give a bond. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This Ordinance will take effect ten days after final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
