"OP" Office Professional District, "NC" Neighborhood Commercial District, "MU" Mixed Use <br />District, "MR" Manufactured Home and Residential District, "MF -18" Multiple - Family <br />Residential District, "MF -12" Multiple - Family Residential District, "LI" Light Industrial <br />District, "HP' Heavy Industrial District, "HC" Heavy Commercial District, "GC" General <br />Commercial District, "D" Duplex Residential District, "CC" Community Commercial District to <br />a SmartCode ( "SC ") District with designations of "74" Transect Zone, "75" Transect Zone and <br />"CS" Civic Space, together with the establishment of SmartCode District designations within the <br />"CBA" Central Business Area District. <br />2. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on April 12, 2011, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on April 19, 2011 regarding the requests. <br />4. All requirements of the San Marcos SmartCode pertaining to Future Land Use Map <br />Amendments and Zoning Map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: • <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan <br />is revised to remove the future land use designation for the Subject Land Area and such future <br />land use designations shall be superseded by the SmartCode zoning designations adopted in <br />Section 2 of this ordinance. <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the Subject Land Area from "MF -24" <br />Multiple- Family Residential District, "SF -6" Single Family Residential District, "D" Duplex <br />Residential District, "TH" Townhouse Residential District, "SF -4.5" Single - Family Residential <br />District, "PH -ZL" Patio Home, Zero - Lot -Line Residential District, "PDD" Planned Development <br />Overlay District, "P" Public and Institutional District, "OP" Office Professional District, "NC" <br />Neighborhood Commercial District, "MU" Mixed Use District, "MR" Manufactured Home and <br />Residential District, "MF -18" Multiple - Family Residential District, "MF -12" Multiple - Family <br />Residential District, "LI" Light Industrial District, "HI" Heavy Industrial District, "HC" Heavy <br />Commercial District, "GC" General Commercial District, "D" Duplex Residential District, "CC" <br />Community Commercial District to a SmartCode ( "SC ") District with designations of "74" <br />Transect Zone, "75" Transect Zone and "CS" Civic Space, as shown in Exhibit "A ". <br />SECTION 3. A SmartCode ( "$C ") District with the designations shown in Exhibit "A is <br />established within the "CBA" Central Business Area District subject to the limitations of this <br />section.
