<br />SAN MARCOS ELECTRIC UTILITY <br />ELECTRIC RATE SCHEDULES <br />STREET LIGHTING & TRAFFIC SIGNAL SERVICE <br />Rate Schedule - SL <br /> <br />I:.rfective: October 1, 2005 <br /> <br />MINIMUM CHARGE <br /> <br />The monthly minimum charge shall be the sum of the CUSTOMER CHARGE and all applicable rate adjustments. <br /> <br />PAYMENT <br /> <br />The due dates, penalty dates, and disconnection dates for bills shall be linked to the Customers' billing cycles in <br />accordance with the following table of dates for each cycle: <br /> <br />Cycle # Billing Date Due Date and Penalty Date Disconnection Date <br />1 16m 3ra of the following month 14m of the following month <br />2 24m 11 m of the following month 2151 of the following month <br />3 151 18m of the same month 28m of the same month <br />4 8m 25m of the same month 4m of the following month <br /> <br />Any and all amounts not paid before the penalty date shall be assessed a charge in the amount of 10% of the unpaid <br />amount. <br /> <br />3yments from state agencies must be received within 30 days from receipt of bill, and any unpaid amount will be subject <br />a 1.0% per month interest charge following the procedures set forth in the Prompt Payment Act. <br /> <br />SPECIAL CONDITIONS <br /> <br />The City will furnish and operate all street lighting facilities required for service under this Schedule SL. Service to <br />locations where City System poles and facilities are not available will be made at the discretion of the City and at an <br />additional charge to the Customer to cover the costs, including appropriate overheads, of additional poles, conductors, <br />other facilities and increased maintenance expenses. The cost of maintaining and repairing any equipment necessary for <br />street lighting service under this Schedule SL shall be billed to the Customer at cost, including appropriate overheads. <br />The City shall, at the request of the Customer, relocate or change existing equipment and the Customer shall reimburse <br />the City for any and all such relocations or changes at actual cost including appropriate overheads. <br /> <br />INTERRUPTION OF SERVICE <br /> <br />The City will make reasonable provisions to ensure satisfactory and continuous service, but does not guarantee a <br />continuous supply of electric power and energy from the City System facilities and shall not be liable for damage <br />occasioned by interruptions of service or failure to commence delivery caused by acts of God, or the public enemy, or for <br />any cause reasonably beyond the control of the City, including, but not limited to, the failure or breakdown of facilities, <br />floods, fire, strikes, or actions or orders of any agency having jurisdiction in the premises, or for interruptions which are <br />necessary for inspection, repair, or changes in the equipment and facilities of the City, the City System or the bulk power <br />supplier(s) to the City System. The Customer shall notify the City immediately of any defect, trouble or accident which <br />may in any way affect the delivery of electric service by the City from the City System. <br /> <br />Page 21 <br />
