<br />generated under this agreement may be subject to release under the Act. The Consultant will not <br />make any reports, information, data, etc. generated under this Agreement available to any <br />individual or organization without the written approval of the City. <br /> <br />10.10 The captions or headings included in this Agreement are for convenience only and in no <br />way define, limit or describe the scope or intent of any provisions, articles, or sections of this <br />Agreement. <br /> <br />ARTICLE 11 <br />PROGRAM GUIDELINES <br /> <br />11.1 Funding for this Project has been made available by HUD through the TDHCA. The <br />Consultant will comply with all of the applicable uniform administrative regulations related to <br />the application, acceptance, and use of federal funds for these federally assisted services. The <br />Consultant is encouraged to obtain the necessary information but failure to do so will not relieve <br />it from compliance with the applicable regulations. <br /> <br />Equal Employment Opportunity <br /> <br />The Consultant will: <br /> <br />11.2 Not discriminate against any employee or applicant for employment because of race, <br />color, religion, national origin, sex, disability or familial status. The Consultant will ensure that <br />applicants are employed, and that employees are treated during employment, without regard to <br />their race, color, religion, national origin, sex, disability or familial status. These actions will <br />include, but not be limited to the following: employment; upgrading; demotion or transfer; <br />recruitment or recruitment advertising; layoff or termination; rates of payor other forms of <br />compensation; and selection for training, including apprenticeship. The Consultant agrees to <br />post in conspicuous places, available to employees and applicants for employment, notices to be <br />provided by the City setting forth the provisions of this non-discrimination clause. <br /> <br />11.3 In all solicitations or advertisements for employees placed by or on behalf of the <br />Consultant, state that all qualified applicants will receive consideration for employment without <br />regard to race, color, religion, national origin, sex, disability or familial status. <br /> <br />11.4 Cause the foregoing provisions to be inserted in all subcontracts for any work covered by <br />this Agreement so that such provisions will be binding upon each sub consultant, provided that <br />the foregoing provisions will not apply to contracts or subcontracts for standard commercial <br />supplies or raw materials. <br /> <br />11.5 Include the provisions 11.2 through 11.4 in every contract or purchase order unless <br />exempted. <br /> <br />Lal)gford Contract <br /> <br />15 <br />
