<br />Sec. 14.381. Surrender and return of suspended license. <br /> <br />Any license suspended under this division shall be surrendered to the building official. At the end of <br />the period of suspension, in the absence of further violations, the surrendered license will be returned <br />to the licensee and will again be valid. If the period of suspension extends beyond the normal <br />expiration date, the licensee shall pay all license renewal fees in order for the building official to return <br />the license. <br /> <br />Sec. 14.382. Appeals. <br /> <br />Under this division, any licensee who has been denied a license or whose license has been suspended <br />or revoked may file a petition with the municipal court within ten days of the date of the denial, <br />suspension, or revocation. The licensee shall also file a copy of the petition with the building official <br />on the same day that the petition is filed with the municipal court. The municipal court will give all <br />parties at least three days notice of the hearing. The municipal court judge will determine whether <br />there is a reasonable basis for the license denial, suspension, or revocation. The judge will determine <br />factual issues by a preponderance of the evidence. <br /> <br />Sees. 14.383--14.400. Reserved <br /> <br />DIVISION 2. LICENSING OF ELECTRICIANS <br /> <br />Sec. 14.401. License required; exceptions. <br /> <br />(a) It is unlawful for any person to perform electrical work subject to this article unless the person is <br />licensed as a master electrician, a journeyman, a residential wireman, a master sign electrician, or an <br />apprentice electrician, unless the person is exempt under any of the following: <br /> <br />(1) The holder of a maintenance electrician license may, during employment by one employer <br />on a full-time basis, perform maintenance, repair and replacement of electrical conductors or <br />equipment peliaining to branch circuits or similar work within the building or premises of the <br />employer without the supervision, direction or control of a master electrician. A maintenance <br />electrician is specifically limited to work on premises owned or controlled by the employer. <br />Maintenance electricians are prohibited from installing any additional wiring or equipment. <br /> <br />(2) A property owner may perform electrical work with the owner's own hands in a residence <br />owned and occupied by the owner as the owner's homestead. All work is subject to permit, inspection <br />and approval in accordance with this article. If the residence is also used as a business, then only a <br />master electrician may apply for a permit. All electrical work performed on the residence shall comply <br />with this article. <br /> <br />(3) Electrical work done by persons engaged by any electric utility in the construction and <br />maintenance of the utility's system are not subject to this article. <br /> <br />(b) Subject to the exceptions stated in subsection (a), no electrical work subject to this article may be <br />performed at any site unless one licensed master or journeyman is present while the work is being <br />performed. <br /> <br />C:\TEMP\bldg code 2-13-02 inc. doc <br /> <br />32 <br />
