<br />16. <br /> <br />RESOLUTION NO. 2002 - 41)R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AN AGREEMENT AUTHORIZING <br />USE OF THE HEARN AVIATION, INC. HANGAR AT THE <br />MUNICIPAL AIRPORT BY EBS, INC.; AUTHORIZING THE CITY <br />MANAGER TO SIGN THE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council, on January 28, 2002, approved a request by EBS, Inc. to sublease a <br />hangar located at the San Marcos Airport from Hearn Aviation, Inc. for the refurbishment of general <br />aviation aircraft, including stripping and painting. <br /> <br />2. Hearn Aviation, Inc. and EBS, Inc had already executed a sublease (the "Sublease") of <br />the hangar dated November 21, 2001, a copy of which is attached. <br /> <br />3. The City, Hearn Aviation, Inc. and EBS, Inc. have negotiated the attached Agreement <br />Authorizing Use of Airport Property for Operation of Business as an alternative to the sublease <br />approved by the Council on January 28, 2002. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Agreement Authorizing Use of Airport Property for Operation <br />of Business between the City, Hearn Aviation, Inc. and EBS, Inc. is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the Agreement <br />on behalf of the City. <br /> <br />PART 3. The approval granted in this resolution is effective only ifthe Agreement is <br />executed by all parties within 30 days after the date of this resolution. <br /> <br />PART 4. The Sublease is approved. <br /> <br />PART 5.
