<br />(b). <br /> <br />SUBCONTRACTOR shall not exclude anyone from p~":;c;pating under this Contract, <br />deny anyone benefits under this Contract, or otherwis: \.:r::a'W'fully discriminate against <br />anyone in carrying out this Contract because of race, c: or. religion, sex, age, disability, <br />handicap, or national origin" <br /> <br />Article 21: Utilization of Small, Minority c and Women's Business Enterprises <br /> <br />(a). A Historically Underutilized Business (HUB) is a Cotporation, Sole Proprietorship, <br />Partnership, or Joint Venture in which as least 51 percent is owned. operated, controlled <br />and actively managed by a person or persons who are rjstcrically underutilized (socially <br />disadvantaged) because of their identification with members of certain groups. including <br />Black Americans, Hispanic Americans, Asian Pacific Americans, Native Americans <br />(American Indians) and Women who suffered the effec:s cf discriminatory practices or <br />similar insidious circumstances over which they have no control. <br /> <br />(b). The SU8CONTAACTOR agrees that qualified Histo,":;al!y Underutilized 8usinesses <br />(HUBs) shall have the maximum practicable opp:rtwnity to participate in the <br />performance of this Contract. <br /> <br />Article 22: Force Majeure <br /> <br />(a). Subject to the requirements or Subsections (b) and (c) 2nd the limitation of Subsection <br />(d), a party's obligations under this Contract are suspended during any period the party <br />is unable to perform its obligations because or work steppage or strike resulting from a <br />tabor dispute; fire, flood, wind. earthquake, or other r.atui'al disaster; epidemic. riot, <br />sabotage, rebellion, or war; governmental intervention; or other oause beyond the party's <br />control. <br /> <br />(b). Subsection (a) does not apply unless the party invoking it notifies the other party of the <br />force majeure event within five business days after it occurs, describing the nature of the <br />event in detail and estimating its likely duration. The pa;ty invoking Subsection (a) has <br />the burden of proving that the force majeure event exists. <br /> <br />(o). If the other party is reasonably satisfied that the force majeure event exists, it shall notify <br />the invoking party that the obligations of this Contract a~ suspended from the effective <br />date of the event throughout its duration. The party invoking Subsection (a) shall notify <br />the other party within five business days after the force :::ajeure event ends. When the <br />force majeure event ends, the obligations of this C::ntract are reinstated for the <br />remainder of the Contract's term, <br /> <br />(d).
