ORDINANCE 2002---2L AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOTS 7, 8, 9 AND 10, BLOCK 40 OF THE VICTORY GARDENS SUBDIVISION, LOCATED IN THE 200 BLOCK OF STILLWELL STREET FROM "C" COMMERCIAL DISTRICT TO "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.. RECITALS: 1. On February 26, 2002, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "C" Commercial District to "R-1" Single-Family Dwelling District for Lots 7, 8, 9, and 10, Block 40 in the Victory Gardens Subdivision located in the 200 Block of Stillwell Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on February 26, 2002 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 8th day of April 2002, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "C" Commercial District to "R-1" Single-Family Dwelling District (Low Density): Street address: 200 Block of Stillwell Street. Legal description: Lots 7, 8, 9 and 10, Block 40 of the Victory Gardens Subdivision. Deed or plat reference: Volume 130, pages 48-52, of the Hays County Deed Records.
