~ 86. LETTER AGREEMENT This Letter Agreement (the "Agreement") is made effective as ofthis I :sr day of IIIIfRCfi ' 2002, by and between W.J. Davis and wife, Alta Faye Davis, (Grantor") and the City of San Marcos, Texas ("Grantee"). WHEREAS, pursuant to a Warranty Deed and City of San Marcos Easement of even date herewith between Grantor and Grantee (copy/s attached hereto), Grantor has granted to Grantee certain rights to lands adjoining Clovis Barker Road; and WHEREAS, the parties desire to set forth their agreement with respect to the consideration to be paid pursuant to the attached conveyance/s; NOW THEREFORE, for good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties hereto agree as follows; 1) Upon City Council approval, the City agrees to pay a cash consideration of $29,540.00 for the Warranty Deed and City of San Marcos Easement; 2) The City shall at City expense install two drive way entrances onto the subject property as part of the Clovis Barker Road reconstruction project. It is understood and agreed that one driveway will be located proximate to the existing driveway, and a second will be constructed approximately one hundred twenty feet from the southern comer of the subject property unless Grantor requests prior to the commencement of construction an alternate location that meets all City specifications for driveway location; and 3) The City shall at City expense remove the road spoils currently located on the southern end of Grantor's property during the Clovis Barker Road reconstruction.
