<br />97. <br /> <br />RESOLUTION 2002- 6 & R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS RATIFYING THE EMERGENCY PROCUREMENT OF <br />CONSTRUCTION SERVICES FOR WATER AND WASTEWATER <br />REPLACEMENTS ON HOLLAND STREET FROM WINSTON <br />CONSTRUCTION, INC.; AUTHORIZING THE PURCHASING MANAGER <br />TO EXECUTE APPROPRIATE PURCHASING DOCUMENTS ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. During the course of construction on Holland Street numerous areas needing <br />water and wastewater replacements were found that were not included as part of the street <br />construction contract. <br /> <br />2. This work was not able to be included in the Holland Street Construction <br />Project and the Water/Wastewater Department could not complete the replacements in the <br />time frame necessary for street construction to proceed. <br /> <br />3. It was necessary to procure these services on an emergency basis from <br />Winston Construction, Inc., without formal competitive bidding in order to preserve and <br />protect the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The emergency procurement of construction services from Winston <br />Construction, Inc. in the total amount of $41 ,454.00 is ratified. <br /> <br />PART 2. The Purchasing Manager, Cheryl Pantermuehl, is authorized to <br />execute appropriate purchasing documents on behalf of the City. <br /> <br />PART 3.
