3. The City Council held a public hearing on May 3, 2011 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Map of the San Marcos Horizons City Master Plan <br />is revised as follows: <br />(a) changing the future land use designation for Tract A from "C" <br />Commercial to "MU" Mixed Use; and <br />(b) changing the future land use designation for Tract B from "LDR" Low <br />Density Residential to "MU" Mixed Use. <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended as follows: <br />(a) rezoning Tract A from "NC" Neighborhood Commercial District to <br />"PDD" Planned Development District with base zoning of "MU" Mixed Use, subject to <br />the provisions of the Planned Development District Standards described in Section 3 of <br />this Ordinance; <br />(b) rezoning Tract B from "MF -12" Multiple - Family Residential District to <br />"PDD" Planned Development District with base zoning of "MU" Mixed Use, subject to <br />the provisions of the Planned Development District Standards described in Section 3 of <br />this Ordinance; and <br />(c) rezoning the remainder of the Project Site to "PDD" Planned Development <br />District with base zoning of "MU" Mixed Use, subject to the provisions of the Planned <br />Development District Standards described in Section 3 of this Ordinance. <br />SECTION 3. The Planned Development District Standards for the Chestnut Street Lofts <br />Planned Development District, attached to this ordinance as Exhibit `B" (the "Regulations "), are <br />approved and adopted to regulate the development of the Project Site. The Project Site will be <br />bound by the provisions of the Regulations as though they were conditions, restrictions and <br />limitations on the use of the Project Site under the City's zoning ordinances. Any person, firm, <br />corporation or other entity violating any provisions of the Regulations shall be subject to all <br />penalties that apply to violations of the zoning ordinances of the City of San Marcos, as <br />
