<br />1.4 The City will reimburse 100% of the total amount spent but in no event will the City <br />reimburse more that $3,000 per residence. Lead requirements are not added to $3,000 <br />limit. <br /> <br />1.5 Payment or reimbursement will be made by the City for completed work only after <br />the work has been inspected and found to be satisfactorily completed by the City's Building <br />Inspector(s). <br /> <br />1.6 Subrecipient has qualified applicants for grant funding under the Income Limits <br />guidelines as set forth by the U. S. Department of Housing and Urban Development <br />established and amended annually by HUD (Exhibit"G"). <br /> <br />1.7 Subrecipient verifies that each qualified applicant( s) has resided in and been the <br />owner(s) of the residence to be rehabilitated for at least six months prior to the submission <br />of its application. <br /> <br />1.8 As to each residence to be rehabilitated under the Project, the Subrecipient verifies: <br /> <br />1.8.1 The residence to be rehabilitated is a permanent, non-mobile housing unit and it <br />cannot be made mobile by the addition of any apparatus used to transport mobile homes. <br /> <br />1.8.2 The residence to be rehabilitated is not located in a flood zone area as defined in <br />the City of San Marcos Flood Insurance Maps, produced by the Federal Emergency <br />Management Agency, or if it is located in a flood zone, the resident has sufficient flood <br />insurance. <br /> <br />1.8.3 The residence is structurally sound and the completion of the rehabilitation will result <br />in significant improvements to the residence. <br /> <br />1.8.4 All property taxes on the property are paid up to date, including City, County and <br />applicable School District Taxes. <br /> <br />1.8.5 The residence is not under a Contract for Deed, or any similar purchase agreement, <br />in which the resident(s) does not obtain legal title until final payment is made. <br /> <br />1.8.6 Resident has not received HUD Program assistance for the preceding five years. <br /> <br />1.9 Subrecipient will ensure that all work performed under this Agreement is permitted <br />and inspected by the City's Department of Planning and Development Services Building <br />Inspections Division. If any work is performed for a residence by a contractor, Subrecipient <br />will ensure that the contractor is duly licensed under City ordinances and State laws. <br /> <br />1.10 Subrecipient understands that it is solely responsible for meeting the terms and <br />conditions of this Agreement.
