<br />128. <br /> <br />RESOLUTION NO. 2002-26.-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS RATIFYING THE APPROVAL OF AN <br />ADJUSTMENT TO THE CITY'S ACCESS LINE FEE FOR <br />TELECOMMUNICATIONS PROVIDERS; AUTHORIZING THE <br />CITY MANAGER TO APPROVE FUTURE ADJUSTMENTS; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. In 1999, the Texas Legislature, in H.B. 1777, enacted Chapter 283 of the Local <br />Government Code, which provides for fees paid by telephone companies for use of city right-of-way <br />to be determined on the basis of the number of active access lines rather than on a percentage of <br />revenues. <br /> <br />2. Beginning this year, the per-access-line fee will adjusted by the Public Utility <br />Commission of Texas (PUC) annually based on changes in the Consumer Price Index (CPI). <br /> <br />3. The PUC recently provided the City with CPI adjustment information for the current year, <br />and the Finance Department submitted the City's approval of the adjustment on April 15, 2002 to <br />meet a PUC deadline. <br /> <br />4. The City Council wishes to ratify the approval of the adjustment for the current year, and <br />the City Council wishes to authorize the City Manager to submit the City's approval of CPI <br />adjustments to the PUC in the future. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council ratifies the approval of the access line fee CPI adjustment <br />submitted to the PUC for the current year. <br /> <br />PART 2. The City Manager is authorized to submit the City's approval of future CPI <br />adjustments to the PUC. <br /> <br />PART 3.
