<br />132. <br /> <br />RESOLUTION NO. 2002- 1S- R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A REVISED OVERSIZE REIMBURSEMENT <br />AGREEMENT BETWEEN THE CITY AND CAPITAL <br />FORESIGHT, L.P.; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City desires to participate in the oversizing of water and wastewater improvements <br />constructed to serve the San Marcos Outlet Park Subdivision, in accordance with the requirements <br />of Section 110.131 of the Subdivision Chapter of the City Code. <br /> <br />2. The City Council adopted a resolution on April 8, 2002 approving an oversize <br />reimbursement agreement with Capital Foresight, L.P. for the San Marcos Outlet Park Subdivision <br />in the amount of $55,392.00. <br /> <br />3. Byrn & Associates, the engineer for Capital Foresight, L.P., has informed the Engineering <br />Department of the need to revise the reimbursement amount. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />P ART 1. The terms and conditions of the attached Revised Oversize Reimbursement <br />Agreement between the City and Capital Foresight, L.P. for the oversizing of utility improvements <br />constructed to serve the San Marcos Outlet Park Subdivision are approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is hereby authorized to execute the Agreement <br />on behalf ofthe City. <br /> <br />PART 3.
