56. RESOLUTION 2002 - 110- R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE CITY'S PARTICIPATION IN THE TEXAS BUILDING AND PROCUREMENT COMMISSION COOPERATIVE PURCHASING PROGRAM; AUTHORIZING THE CITY MANAGER AND THE PURCHASING MANAGER OF THE CITY TO ACT IN MATTERS RELATED TO THE THIS PROGRAM AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The Texas Building and Procurement Commission ("TBPC") is authorized to provide purchasing services for local governments pursuant to Title 8. Subtitle C. Chapter 271, Subchapter D. Sections 271.082 and 271.083 of the Local Government Code. 2. The City Council of the City of San Marcos, is a local government defined as an entity qualified to participate in the Cooperative Purchasing Program of the TBPC pursuant to section 271.081 of the Local Government Code. 3. In accordance with the requirements of Section 113.85(a) of the TBPC administrative rules, the Agents of Record, Cheryl Pantermuehl, Purchasing Manager and Dan O'Leary, Interim City Manager are authorized to execute any and all documentation for the City of San Marcos pertaining to its participation in the TBPC Cooperative Purchasing Program. 4. The City acknowledges its obligation to pay participation fees established by the TBPC Cooperative Purchasing Program. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That a request be made to the Texas Building and Procurement Commission to approve the City of San Marcos for participation in the Texas Building and Procurement Commission Cooperative Purchasing Program. PART 2. The Purchasing Manager and the Interim City Manager are designated as the City's Agents of Record for purposes of participation in the TBPC Cooperative Purchasing Program. PART 3.
