<br />56. <br /> <br />RESOLUTION 2002 - 110- R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE CITY'S PARTICIPATION IN THE TEXAS <br />BUILDING AND PROCUREMENT COMMISSION COOPERATIVE <br />PURCHASING PROGRAM; AUTHORIZING THE CITY MANAGER AND <br />THE PURCHASING MANAGER OF THE CITY TO ACT IN MATTERS <br />RELATED TO THE THIS PROGRAM AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS: <br /> <br />1. The Texas Building and Procurement Commission ("TBPC") is authorized to <br />provide purchasing services for local governments pursuant to Title 8. Subtitle C. Chapter <br />271, Subchapter D. Sections 271.082 and 271.083 of the Local Government Code. <br /> <br />2. The City Council of the City of San Marcos, is a local government defined as <br />an entity qualified to participate in the Cooperative Purchasing Program of the TBPC <br />pursuant to section 271.081 of the Local Government Code. <br /> <br />3. In accordance with the requirements of Section 113.85(a) of the TBPC <br />administrative rules, the Agents of Record, Cheryl Pantermuehl, Purchasing Manager and <br />Dan O'Leary, Interim City Manager are authorized to execute any and all documentation <br />for the City of San Marcos pertaining to its participation in the TBPC Cooperative <br />Purchasing Program. <br /> <br />4. The City acknowledges its obligation to pay participation fees established by <br />the TBPC Cooperative Purchasing Program. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That a request be made to the Texas Building and Procurement <br />Commission to approve the City of San Marcos for participation in the Texas Building and <br />Procurement Commission Cooperative Purchasing Program. <br /> <br />PART 2. The Purchasing Manager and the Interim City Manager are designated <br />as the City's Agents of Record for purposes of participation in the TBPC Cooperative <br />Purchasing Program. <br /> <br />PART 3. The expenditure of funds to pay participation fees established by the <br />TBPC is authorized. <br /> <br />PART 4. <br />passage. <br /> <br />This resolution shall be in full force and effect from and after its <br />
