On May 28, 2002, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "PD" Pre-Development <br />District to "C" Commercial District for a 4.23 acre tract of property located in the 2100 Block of <br />IH- 35 North. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on May 28, 2002 consider and vote to approve the request, and has recommended that the <br />request be approved by the City Council of the City. <br /> <br />3. The City Council held public hearings regarding the request on June 24, 2002 and July <br />8, 2002. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property which is presently <br />zoned "PD" Pre-Development District to "C" Commercial District: <br /> <br />Street address: <br /> <br />2100 Block ofIH-35 North. <br /> <br />Size: 4.23 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 184, page 106, Hays County Deed Records. <br />
