<br />SECTION 2. The period of suspension of the filing, processing and issuance of permits for the <br />erection or construction of new off-premise signs, except for purely ideological signs, is extended to <br />include the period from July 30, 2002 through January 24,2003. <br /> <br />SECTION 3. During the suspension period, the City staff is directed to work with the sign <br />industry and the citizens and businesses of the City to develop and present to the City Council proposed <br />revisions to the City's current ordinances on off-premise signs, in time for consideration and adoption by <br />the City Council within the suspension period. <br /> <br />SECTION 4. A. All applications for permits for off-premise signs that are filed with the City's <br />Planning and Development Services Department before the effective date of Ordinance No. 2002-7 shall <br />continue to be processed by the City staff in accordance with the regulations and ordinances in effect prior <br />to the period of permit suspension. An application will not be deemed to be filed unless and until it has <br />been determined by the Planning and Development Department staff to contain or be accompanied by all <br />required application information, and all applicable fees have been paid. <br /> <br />B. An off-premise sign erected during the suspension period as a purely ideological sign must <br />comply with all regulations for off-premise signs, and cannot thereafter be changed to advertise any <br />commercial business, product, service or event unless it is otherwise allowed at that location under <br />applicable City ordinances. <br /> <br />SECTION 5. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will <br />continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 6. All ordinances and resolution or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed to the extent and for the period of time needed to give this ordinance effect. <br /> <br />SECTION 7. Any person violating any provision of this ordinance commits a misdemeanor and <br />is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br />SECTION 8. The importance of this Ordinance creates an emergency and an imperative public <br />necessity, and the provisions of the Charter requiring that ordinances be presented at three separate <br />meetings, and that ordinances do not take effect until ten days after the date of final passage are <br />suspended, and this Ordinance will take effect upon publication of notice of its adoption in a newspaper of <br />general circulation within the City. <br /> <br />PASSED, APPROVED AND ADOPTED on Jne 24, 2002. <br />~~.~ <br /> <br />Robert B.
