101. PROFESSIONAL SERVICES AGREEMENT FOR THE COORDINATION OF THE CENTRAL TEXAS HOUSEHOLD HAZARDOUS WASTE MOBILE PROGRAM This AGREEMENT is made this the 2Sth day of ,Tllnp ,2002, between the City of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Geo-Visions (the "Consultant"), 9709 Timber Ridge Pass, Austin, Texas 78733, for the provision of professional services for the coordination of the Central Texas Household Hazardous Waste Mobile Program for the City of San Marcos. The City and the Consultant agree as follows: ARTICLE 1 CONSULTANT'S SERVICES AND RESPONSIBILITIES 1.1 STANDARDS OF PERFORMANCE 1.1.1 Consultant will be responsible for the professional coordination services for the Central Texas Household Hazardous Waste Mobile Program for the City of San Marcos (the "Project"). The purpose of this Project is to provide affordable household hazardous waste collection through a regional household hazardous waste management program which includes an educational campaign in addition up to four one-day collection events. This Project is under the sponsorship of the City and will include affordable household hazardous waste collection for the City of San Marcos, Hays County, The Barton Springs Edwards Aquifer Conservation District, the City of Lockhart, the City of Luling, the City of Giddings, the City of Lakeway, the Travis County Water Control and Improvement Disctrict No. 17 and the Hurst Creek M.U.D. (the "Participating Communities"). This Project is being financed in part with funds from the Texas Natural Resource Conservation Commission ("TNRCC") through a grant from the Capital Area Planning Council CAPCO"). The Consultant certifies that it is fully familiar with federal, state and local regulations regarding household hazardous waste collection and other waste streams. Consultant is experienced and familiar with all reporting requirements of both CAPCO and the TNRCC. Consultant will perform all of its services so that the Project will proceed in accordance with the guidelines promulgated by the TNRCC and CAPCO. 1.1.2 The Consultant's services are described in Sections 1.1 through 1.9. 1.1.3 The performance of all services by the Consultant in connection with this Agreement will be by persons appropriately licensed or registered under State, local and Federal laws governing their respective consulting disciplines. In performing all services under this Agreement, the Consultant will use that degree of care and skill ordinarily exercised for similar projects by professionals who possess special expertise in the types of services involved under this Agreement. No work under this Agreement will be subcontracted by the Consultant without prior written approval from the City.
