C"-.J w~ W~ ~ ....Ie: ..Jo Oas -- >C/) [~ ~ ....- -0 0>.. :IE - . u AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS HORIZONS CITY MASTER PLAN ADOPTED IN SECTION 102.026 OF THE CITY CODE BY ADOPTING A NEW APPENDIX ENTITLED "P ARKS, RECREATION AND OPEN SP ACE MASTER PLAN"; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Section 102.026 of the City Code adopts the San Marcos Horizons City Master Plan as the master plan for the physical development of the City. 2. The Parks and Recreation Board and the Parks and Recreation Department staff have overseen the preparation of a new appendix to the master plan entitled "Parks, Recreation and Open Space Master Plan". 3. The Planning and Zoning Commission has conducted public hearings on this appendix on May 22,2001 and on January 22,2002, and voted to recommend the adoption of this appendix by the City Council. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The San Marcos Horizons City Master Plan adopted in Section 102.026 of the City Code is amended by the adoption and addition of an appendix entitled "Parks, Recreation and Open Space Master Plan" in the form attached to this ordinance. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
