<br />130. <br /> <br />AMENDMENT NO.5 TO DEVELOPMENT INCENTIVE AGREEMENT BETWEEN <br />THE CITY OF SAN MARCOS AND DOUBLE EAGLE VENTURES, INC. <br />FOR CONWAY ADDITION SECTION 4 DEVELOPMENT <br />IN THE 600 AND 700 BLOCKS OF STURGEON STREET <br /> <br />This is Amendment No.5 to the Development Incentive Agreement dated March 24, 1998 <br />(the "Agreement") between the City of San Marcos, Texas (the "City"), a Texas municipal <br />corporation, and Double Eagle Ventures, Inc. (the "Developer"), a Texas corporation. <br /> <br />The parties agree to amend the Agreement as follows: <br /> <br />1. Section 3.A. of the Agreement is amended as follows (underlining indicates added <br />text and ()~eUltI ike indicates deleted text): <br /> <br />A. In consideration for the construction ofthe Project by the Developer, the City <br />agrees to waive City fees (the "Fee Waiver") associated with the Project, including those for <br />subdivision platting, engineering review, and site development. Any of these fees that have <br />already been paid will be refunded by the City. The City also agrees to waive fees for <br />building permits, plan checking, water and wastewater connections, and contractor licensing <br />associated with the construction of single- family residences on the Property by the Developer <br />or by others that become payable on or before June 30, 2004 2BB2-. <br /> <br />2.
