<br />161. <br /> <br />RESOLUTION 2002- 142 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT <br />WITH DU-MOR ENTERPRISES INC. FOR THE S.H. 21 WATER LINE <br />RELOCATION PROJECT; AUTHORIZING THE INTERIM CITY MANAGER <br />TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On May 28, 2002 the Texas Department of Transportation (TxDOT) <br />requested that the City immediately prepare to relocate a 12 inch waterline in SH 21 right- <br />of-way outside of the proposed roadway expansion. <br /> <br />2. Upon receipt of TxDOT's request, the City immediately prepared construction <br />plans for the relocation of the water line. <br /> <br />3. Du-Mor Enterprises is available to complete this work in a timely fashion. <br /> <br />4. It is necessary to have the work completed by Du-Mor Enterprises on an <br />emergency basis without formal competitive bidding in order to comply with TxDOT <br />directives and to preserve and protect the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The award of an emergency contract to Du-mor Enterprises for the <br />S.H. 21 Water Line Relocation Project in the amount of in the amount of $196,035.00 is <br />approved. <br /> <br />PART 2. The Interim City Manager, Dan O'Leary is authorized to execute the <br />contract documents on behalf of the City. <br /> <br />PART 3.
