<br />172. <br /> <br />RESOLUTION NO. 2002--14!}R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A MASTER <br />ADVANCE FUNDING AGREEMENT BETWEEN THE CITY AND THE <br />TEXAS DEPARTMENT OF TRANSPORTATION; AUTHORIZING THE <br />INTERIM CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) and the Transportation Equity <br />Act for the 21st Century (TEA-21) codified under Title 23 U.S.c. Section 101 et seq., authorize transportation <br />programs to meet the challenges of protecting and enhancing communities and the natural environment and advancing <br />the nation's economic growth and competitiveness. <br /> <br />2. ISTEA and TEA-21 establish federally funded programs for transportation improvements to implement <br />their public purposes. <br /> <br />3. Title 23 U.S.C. Section 134 requires that Metropolitan Planning Organizations and the States' <br />transportation agencies to develop transportation plans and programs for urbanized areas of the State. <br /> <br />4. The Texas Transportation Code, Sections 201.103 and 222.052 establish that the State shall design, <br />construct and operate a system of highways in cooperation with local governments. <br /> <br />5. Federal and state laws require local governments to meet certain contract standards relating to the <br />management and administration of State and federal funds. <br /> <br />6. The governing terms ofthe attached Master Advance Funding Agreement will provide for efficient and <br />effective contract administration of the types of Local Project Advance Funding Agreements (LP AF A) listed in <br />Attachment A. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Master Advance Funding Agreement between the City of San Marcos and the Texas <br />Department of Transportation is approved. <br /> <br />PART 2. The Interim City Manager, Dan O'Leary, is authorized to execute the agreement on behalf of the <br /> <br />City. <br /> <br />PART 3.
