<br />188. <br /> <br />GREENPOINTE SUBDIVISION <br /> <br /> <br />DEVELOPMENT STANDARDS <br /> <br />The following are restrictions and requirements for the property being platted as Greenpointe <br />Subdivision. <br /> <br />1. Greenpointe Subdivision shall consist of a maximum of sixteen lots for single family residential. <br />2. The road shall be a gated private roadway to be owned and maintained by the Homeowners <br />Association. <br />3. The roadway shall be 22 feet wide typically with a turn around and islands that preserve trees. <br />4. Roadway alignment shall accommodate car and truck traffic, but shall encourage a slower speed. <br />5. Paths shall be provided adjacent to the roadway that will be covered with a crushed granite material <br />or equivalent. <br />6. Each lot shall be allowed a single driveway entrance. <br />7. Building setback is twenty feet minimum. <br />8. The undersigned, owner of the property comprising the Greenpointe Subdivision, hereby dedicates a <br />perpetual Conservation Easement to the City of San Marcos around the perimeter of the subdivision <br />in the areas shown on the subdivision plat. The City of San Marcos and its officers and employees <br />may enter the easement to inspect for compliance with these standards, but the general public is not <br />granted any right of access to the easement. The undersigned, on behalf of itself and all successors <br />in interest to all or any part of the property in the subdivision, agrees not to undertake, engage in, <br />cause, or permit, any of the following activities, actions or uses of, on, or with respect to the <br />Conservation Easement: <br />A. The placement, construction or maintenance of any buildings, decks, or other structures, <br />regardless of method or materials of construction. <br />B. The placement, construction or maintenance of roads, parking areas, or driveways, regardless <br />of method or materials of construction. <br />C. The placement, construction or maintenance of sidewalks, walkways, or trails consisting of <br />any form of impervious paved surface, such as concrete, asphalt, or paver stones. Walkways or <br />trails consisting of pervious surfaces such as decomposed granite are permitted. <br />D. Any cutting, pruning or trimming of trees or vegetation, except for the removal of dead or <br />decayed trees or portions of trees that pose a direct threat to human life or property. <br />E. Dumping or depositing garbage, trash, or other waste materials, or failing to remove and <br />properly dispose of any such waste materials, regardless of source. <br />9. Each lot shall be limited to a maximum of 5,000 square feet of lot space that can be cleared. Clearing <br />shall be limited to areas that are not within the Conservation Easement and the Sensitive Feature <br />Protection Zones. All remaining space (excluding Conservation Easement and Protection Zones) <br />within each lot shall be restricted to limited clearing. Limited clearing shall include the removal of <br />dead vegetation, cactus, small bushes and the pruning of existing trees. <br />10. Each lot shall be limited to the construction of a maximum of 5,000 square feet of impervious cover, <br />which shall include house, garage, drives, sidewalks, patios, porches, etc. <br />11. All structures erected shall be required to have rainwater collection systems that will collect and hold <br />the equivalent roof runoff as a minimum the twenty five year storm discharge. The rainwater <br />collected is intended to be used for irrigation as a minimum. <br />12. All utilities shall be installed underground. <br />13. These development standards have been adopted by the San Marcos City Council as a part of the <br />PDD zoning ordinance for the property in the subdivision, and are binding features of the PDD <br />zoning district for the property.
