<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, MAKING
<br />NONSUBST ANTIVE REVISIONS TO THE CITY
<br />CHARTER; INCLUDING PROCEDURAL
<br />PROVISIONS; AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />RECIT ALS:
<br />
<br />1. Section 12.13 of the City Charter provides that the City Council "shall have the power, by
<br />ordinance, to renumber, rearrange and make non-substantive corrections to all articles, sections, and
<br />paragraphs of this Charter".
<br />
<br />2. The 2001 Charter Review Commission, in its report, recommended one general change to the
<br />Charter, to remove duplicated numbers (e.g., "twenty-four (24) hours"), and non-substantive amendments to
<br />Sections 5.02, 6.03 and 9.03 of the Charter.
<br />
<br />3. The City Council wishes to make the non-substantive changes to the City Charter recommended
<br />by the Charter Review Commission.
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. Sections 3.01, 3.06(b), 3.10, 3.11, 3.12, 4.01(b), 5.03, 5.05, 6.03, 6.04, 6.06(c), 6.07,
<br />6.08,6.10,8.06,8.09,8.10,8.14, 10.02, 10.07(a), 12.06, and 12.12 of the City Charter are amended as follows

<br />Sec. 3.01. Number, selection and term.
<br />
<br />The legislative and governing body of the city shall consist of seven f+1 council members and shall
<br />be known as the "City Council of San Marcos".
<br />
<br />(a) The members of the city council shall be elected from the city at large, and each council member
<br />shall be elected to occupy a place on the council, such places being numbered and designated 1,2,3,
<br />4, 5, 6 and mayor.
<br />
<br />(b) Each council member for places 1,2,3,4,5 and 6 shall hold office for a period ofthree ~ years,
<br />staggered so that two R1 members shall be elected to a regular term each year. The council member
<br />elected to the place of mayor shall hold office for a period of two R1 years.
<br />
<br />Sec. 3.06. Vacancies.
<br />
<br />(b) No such election shall be held sooner than thirty (301 days from the date it is called.
