<br />issuance. All such forms must be returned to the city clerk before their respective expiration dates in <br />order to be eligible to be verified and certified by the city clerk. The city clerk shall have forty five <br />f451 days from the receipt of any recall petition or petitions to verify and certify to their sufficiency. <br /> <br />Sec. 6.08. Recall election. <br /> <br />The provisions regulating examination, certification and amendment of initiative petitions shall <br />apply to recall petitions. If the petition is certified by the city clerk to be sufficient, the council shall <br />order and hold an election to determine whether such officer shall be recalled. The election shall be <br />held on the date next authorized by state law for municipal elections which is at least thirty (301 days <br />after certification of the petition calling for the recall election. <br /> <br />Sec. 6.10. Limitation on recall. <br /> <br />No recall petition shall be filed against a council member within six ~ months after taking office, and <br />no council member shall be subjected to more than one EB recall election during a term of office. <br /> <br />Sec. 8.06. Notice of public hearing on budget. <br /> <br />At the meeting of the city council at which the budget is submitted, the city council shall fix the time <br />and place of public hearing on the budget and shall cause to be published in one EB or more <br />newspapers of general circulation in the City of San Marcos a general summary of the proposed <br />budget and a notice of the hearing setting forth the time and place thereof, the time for which <br />publication shall be in accordance with applicable law. <br /> <br />Sec. 8.09. Adoption after public hearing. <br /> <br />The budget shall be adopted only after fourteen ( 141 days have lapsed since the public hearing on the <br />budget. <br /> <br />Sec. 8.10. Date of final adoption. <br /> <br />The budget shall be finally adopted not later than fifteen (151 days prior to the expiration ofthe fiscal <br />year, and should the city council fail to so adopt a budget, the then existing budget together with its <br />tax levying ordinance and its appropriation ordinance, shall be deemed adopted for the ensuing fiscal <br />year. <br /> <br />Sec. 8.14. Contingent appropriation. <br /> <br />Provision shall be made in the annual budget and in the appropriation ordinance for a contingent <br />appropriation in amount not more than three ~ per centum of the total budget, to be used in case of <br />unforeseen items of expenditure. Such contingent appropriation shall be under the control of and <br />distributed by the city manager after approval of the city council. Expenditures from this appropriation <br />shall be made only in case of established emergencies and a detailed account of such expenditures <br />shall be recorded and reported. <br /> <br />-5- <br />
