60. RESOLUTION NO. 2002- 175 R --- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S WATER AND WASTEWATER SYSTEMS TO SERVE THE PROPOSED COTTONWOOD CREEK DEVELOPMENT ADJACENT TO STATE HIGHWA Y 123; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. City Code Section 86.003( c) requires City Council approval for the extension of City water or wastewater mains to serve uses outside the City limits. 2. Vision Land Group, Ltd. (the "Applicant"), on behalf of itself and Jim R. Smith, has requested permission to extend City water and wastewater mains to serve the Applicant's property, as described on the attached map (the "Property"), which is outside the city limits, to be developed as the Cottonwood Creek Subdivision Development. 3. These main extensions appear to be feasible and are to be constructed at the sole expense of the Applicant, subject to the City's policies on oversizing. 4. The Property is located in the City's certificated water service area. 5. The Applicant has submitted a written request for annexation of the Property by the City. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The extension of the City's water and wastewater system mains to serve the Property, to be constructed at the sole expense ofthe Applicant (subject to the City's policies on oversizing), and on the basis of the Applicant's request for mmexation of the Property, is approved. This approval is subject to the submission by the Applicant to the City of written requests for annexation from all property owners along the east side of State Highway 123 between the Property and the property proposed for development as the Camino Real development, and will take effect upon submission of such written requests.
