ORDINANCE 2002- 62 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0,74 ACRE TRACT OF PROPERTY LOCATED IN THE 1600 BLOCK OF RIVER ROAD FROM "MF-3" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES, RECITALS: 1. On July 23, 2002, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "MF-3" Multi-Family District (High Density) to "C" Commercial District for a 0.74 acre tract of property located in the 1600 Block of River Road, 2, Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on July 23, 2002 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City, 3. The City Council held a public hearing on the 23rd day of September , 2002, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "MF-3" Multi-Family District (High Density) to "C" Commercial District: Street address: 1600 Block of River Road. Size: 0.74 acre. Legal description: See the metes and bounds description attached as Exhibit A.
