The City Planning and Zoning Commission conducted a public hearing on July 9,2002 <br />on a proposed amendment to Section 114.027 regarding the appeal of decisions of the Planning and <br />Zoning Commission on specific use permits to the City Council. <br /> <br />2. The Planning and Zoning Commission voted on July 9,2002 to recommend the proposed <br />changes for adoption by the City Council. <br /> <br />3. The City Council conducted a public hearing on the proposed changes on August <br />26,2002. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 114.027 of the Zoning Chapter of the City Code is amended as follows <br />(underlining indicates added text; overstrike indicates deleted text): <br /> <br />Sec. 114.027. Appeals for specific use permits. <br /> <br />~Any person jointly or severally aggrieved by any decision of the planning and zoning <br />commission on a specific use permit may appeal the decision present to the city council 121 <br />submitting to the director a completed appeal request on the form provided by the director <br />within 10 days of the date of the decision a statement, duly verified, setting forth that the <br />decision is unjust, in whole or in part, specifying the grounds of injustice. The statement shall <br />be presented to the city council within 30 days after the final decision of the plar.J1ing and <br />zoning commission for notification and calling of a public hearing to hear and act on the <br />appeal. <br /> <br />(b) The city council will conduct a public hearing on the appeal. Notice of the public hearing <br />will be published as described in section 114.023. <br /> <br />( c) After conducting the public hearing, the council may sustain or reverse the decision of <br />the planning and zoning commission on the permit.
