<br />99. <br /> <br />ADDENDUM TO <br />ASSIGNMENT OF REAL ESTATE LEASE AND AGREEMENT <br /> <br />This is an addendum to the Assignment of Real Estate Lease and Agreement (the Assignment") <br />between Berry Aviation, Inc. ("Borrower"), the City of San Marcos ("Lessor") and the Small Business <br />Administration ("Assignee") related to the lease of property at 1807 Airport Drive, San Marcos, Texas <br />78666, between the Borrower and the Lessor dated December 1, 1992 (the "Agreement"). The parties <br />agree to amend Section A, Paragraph 4 of the Assignment to revise the last full paragraph at the end of <br />that subsection as follows (underlining indicates added text): <br /> <br />In the event Assignee shall only undertake the options provided in Paragraphs 4a or 4b, it shall~ <br />have no obligation other than payment of rent accruing during the period of its possession of the <br />premises, such period not to exceed 90 days. The Lessor may terminate said lease at any time <br />after that period if Lessor has given notice of default in accordance with Paragraph 3 and the <br />default has not been cured. In the event Assignee shall make transfer of said lease as provided in <br />Paragraph 4c, Assignee will cure all defaults in said lease, and its sole other obligation shall be <br />the payment of rent which occurred prior to the transfer of said lease. <br />
