RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, ~eld on September 23, 2002, and on September 24, 2002, to consider the proposed annexation by the City of 677 acres, more or less, located along and adjacent to the 2500 to 4500 blocks of State Highway 123, in Hays County and Guadalupe County, Texas, consisting of the tracts ofland described by metes and bounds in the attached Exhibits B-1 through B-ll (the "Annexation Area"). 2. The City has received petitions for annexation from the owners of portions of the property included in the Annexation Area, a copy of each of which is attached to this ordinance as Exhibit A. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on September 11, 2002 and September 12, 2002, these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 6. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 8. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote(s) on adoption of this
