AND MRS. GUillERMO <br />SOTO; AUTHORIZING THE CITY MANAGER TO EXECUTE SPECIAL <br />WARRANTY DEEDS; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is the owner of the eastern % of lot 57, Riverside Addition. <br /> <br />2. A staff analysis has been made that has determined that there is no present or <br />anticipated future need for the City to retain this property. <br /> <br />3. Since the subject property is not suitable to be used as an independent lot, the sale of <br />the property for its appraised value to the adjacent landowners, Richard Deleon and Mr. <br />and Mrs. Guillermo Soto, is authorized by Section 272.001 (b)(1) of the Texas local <br />Government Code. <br /> <br />BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The sale of the western % of the parcel of real property described in Recital <br />1 above to Richard Deleon is approved, and the sale of the eastern % of the parcel of real <br />property described in Recital 1 above to Mr. and Mrs. Guillermo Soto is approved. <br /> <br />SECTION 2. The City Manager, Dan O'leary, is authorized to execute the attached <br />Special Warranty Deeds conveying to Richard Deleon and to Mr. and Mrs. Guillermo Soto <br />the respective properties described above. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions <br />of this ordinance will continue in full force if they can be given effect without the invalid <br />portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br />
