The current tables of utility payment due dates, penalty dates, and disconnection dates <br />contained in the City's electric utility rate schedules include a four-day gap between the payment <br />due date and the late payment penalty date. This gap causes the City to mail a large number of <br />past-due notices each month prior to the date that late payment penalties are owed. The Finance <br />Department has recommended that the electric utility rate schedules be revised to make utility <br />payment due dates correspond to late payment penalty dates, thereby eliminating the gap between <br />payment due dates and payment penalty dates, and the need to mail a large number of past-due <br />notices each month. The City Council wishes to implement this recommendation by revising the <br />electric utility rate schedules. <br /> <br />2. The City Council wishes to set fees for discoill1ection and recOlmection of electrical <br />service at premises where service is discontinued by a police officer under City Code Section <br />34.101 because of a noise nuisance that constitutes an imminent threat to public safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The City's electric utility rate schedules established under City Code <br />Section 86.167 are repealed and are replaced by the electric utility rate schedules attached to this <br />ordinance. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any prOVlSlon of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br /> <br />C:\TEMP\electric rate schedule adoption.doc <br />
