<br />16. <br /> <br />RESOLUTION NO. 2002- 205 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE FUTURE <br />LAND USE PLAN OF THE CITY MASTER PLAN, FROM <br />OPEN SP ACEIFLOODW A Y, COMMERCIAL AND <br />INDUSTRIAL TO COMMERCIAL, HIGH DENSITY <br />RESIDENTIAL AND OPEN SP ACEIFLOODW A Y FOR A <br />239 ACRE, MORE OR LESS, TRACT OF PROPERTY <br />LOCATED IN THE 2700 BLOCK OF IH-35 NORTH; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECIT ALS: <br /> <br />1. On November 12, 2002, the City Planning and Zoning Commission held a <br />public hearing regarding a request to amend the Future Land Use Plan of the City Master <br />Plan from Open Space/Floodway, Commercial and Industrial to Commercial, High <br />Density Residential and Open Space/Floodway for a 239 acre, more or less, tract of <br />property located in the 2700 Block ofIH-35 North. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on November 12,2002, consider the request and voted to approve it and <br />has recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on November 25, 2002 <br />regarding the request. <br /> <br />4. City Code Section 102.028(a)(3) authorizes the City Council to revise the <br />future land use plan by adopting a resolution, after conducting a public hearing and <br />receiving the recornn1endation of the Planning and Zoning Commission. <br /> <br />5. The City Council hereby finds and determines that the adoption of the <br />following resolution is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. The following tract of real property (the "Property"), which is shown <br />on the Future Land Use Plan of the Master Plan of the City as Open Space/Floodway <br />(55.9 acres), Commercial (91.4 acres) and Industrial (92.0 acres), is revised to be shown <br />on the Future Land Use Plan of the Master Plan of the City as Commercial (118.3 acrs), <br />High Density Residential (65.1 acres) and Open Space/Floodway (55.9 acres): <br /> <br />Street address: 2700 Block of IH-35 North <br />
