<br />Service Plan <br /> <br />IH-35 North Annexation <br /> <br />5. Operation and Maintenance of Water and Wastewater Facilities <br />a. Water <br />Portions of the proposed annexation area are served by the Maxwell Water Supply <br />Corporation. Existing Maxwell customers will continue to be served by that company <br />and will see no change in service or fees as a result of the annexation. <br /> <br />Other portions of the proposed annexation area are currently served by the City of San <br />Marcos. Existing water lines are in place to serve current development. The City will <br />continue to provide operation and maintenance of these water lines. <br /> <br />As new development occurs within the City's service area, the City will provide water <br />service to properties in accordance with the city's development ordinances and utility <br />extension policies in place at the time of development. Upon completion and dedication <br />of the new facilities to the city, the city shall provide on-going maintenance and operation <br />of those facilities. <br /> <br />b. Wastewater <br />Wastewater service lines are currently in place within the proposed annexation area. <br />These lines may be accessed for service to properties, subject to the city's utility <br />connection policies and subject to existing capacity limitations. Operation and <br />maintenance of existing public wastewater facilities in the area of the annexed property <br />are the responsibility of the City of San Marcos. <br /> <br />Should an owner of property in this area elect to further develop their property at <br />some point in the future, the City of San Marcos will provide wastewater service <br />to properties in accordance with the city's development ordinances and utility <br />extension policies in place at the time of development. Upon completion and <br />dedication of the new facilities to the city, the city shall provide on-going <br />maintenance and operation of those facilities. <br /> <br />6. Operation and Maintenance of Roads and Streets <br />Approximately 4,700 linear feet (0.9 miles) of roads are included as part of this <br />annexation and include all of the existing roads located inside of the Champion's <br />Business Park subdivision. Routine maintenance of these roadways will begin on the <br />effective date of the annexation, subject to the replatting of the subdivision and <br />dedication of the roadways to the City. This annexation also includes approximately <br />3,500 linear feet ofIH-35. The Texas Department of Transportation will continue <br />maintenance ofIH-35 and its frontage roads. <br /> <br />As new development occurs within the annexed area, the developers of property will be <br />required to construct streets in accordance with the city's existing subdivision policies. <br />Upon completion and dedication of new facilities to the city, the city shall provide on- <br />going operation and maintenance for those facilities. <br /> <br />EXHIBIT "c" <br />Page 2 of 3 <br /> <br />DRAFT: September 27,2001 <br /> <br />Page 2 of3 <br />
