DRIVE, THE <br />200 THROUGH 500 BLOCKS OF CENTRE STREET, AND <br />THE 200 BLOCKS OF HERNDON STREET, SHADY LANE, <br />SOUTH COMANCHE STREET AND SOUTH <br />FREDERICKSBURG STREET; INCLUDING <br />PROCEDURAL PROVISIONS; PROVIDING FOR <br />PENAL TIES; AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. The Historic Preservation Commission has recently discussed the possible creation of <br />a Dunbar Historic District in the 200 through 600 blocks of Martin Luther King, Jr. Drive, the <br />200 through 500 blocks of Centre Street, and the 200 blocks of Herndon Street, Shady Lane, <br />South Comanche Street and South Fredericksburg Street, as depicted on the attached map (the <br />"Proposed District"), and on November 18, 2002, the Commission held a public hearing on the <br />boundaries of the Proposed District. <br /> <br />2. The Proposed District will need to be reviewed by the Planning and Zoning <br />Commission and the Texas Historical Commission before being proposed for adoption by the <br />City Council. <br /> <br />3. Several structures with potential historic value have recently been demolished in the <br />area of the Proposed District. <br /> <br />4. The Historic Preservation Commission has recommended that the City Council impose <br />a suspension on the issuance of demolition permits within the Proposed District for a period of <br />180 days to protect against the loss of additional historically significant structures, and to provide <br />time to adequately consider the alternatives and to give all parties the opportunity to express their <br />concerns with the Proposed District. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The processing and issuance of demolition permits for structures in the <br />Proposed District is hereby suspended for a period of 180 days from the effective date of this <br />ordinance. This suspension does not apply to the processing and issuance of permits for the <br />demolition of structures that are determined by the City Building Official to pose an imminent <br />danger to the public. <br /> <br />SECTION 2. All applications for demolition permits that are filed with the City's <br />Building Inspection Division before the effective date ofthis ordinance shall be processed by the <br />City staff in accordance with the regulations and ordinances in effect prior to the period of permit <br />
