<br />117. <br /> <br />RESOLUTION NO. 2002- 227 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br />OF AN AGREEMENT BETWEEN THE CITY AND MAXWELL <br />WATER SUPPLY CORPORATION PERTAINING TO AN <br />EXCHANGE OF WATER SERVICE AREAS; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE AGREEMEKT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On December 2,2002, the City Council approved an agreement (the "Project Agreement") <br />with the Bennett Realty Group, Perry Financial Corporation, Chuck Nash, and Dam Blanco Partnership <br />for joint participation in funding the costs of the North IH-35 Wastewater Improvements Project (the <br />"ProjecC). <br /> <br />2. The Project Agreement calls for the City to cooperate with Maxwell Water Supply <br />Corporation ("Maxwell") in exchanging portions of their certificated water service areas so that the <br />service area boundaries of the City and Maxwell correspond to property ownership boundaries in the <br />area of the Project. <br /> <br />3. The City has negotiated the attached agreement with Maxwell to implement this part of the <br />Project Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The attached agreement between the City of San Marcos and Maxwell peltaining to <br />an exchange of water service areas is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached af,'Teement on <br />behalf of the City. <br /> <br />PART 3.
