252. RESOLUTION 2001 - 16 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE TEXAS PARKS AND WILDLIFE DEPARTMENT THROUGH THE TEXAS RECREATION AND PARKS ACCOUNT REGIONAL PARKS PROGRAM FOR THE ACQUISITION OF PARK PROPERTY; CERTIFYING THAT THE CITY IS ELIGIBLE TO RECEIVE ASSISTANCE UNDER THIS PROGRAM; CERTIFYING THAT THE CITY'S MATCH OF 50 PERCENT IS AVAILABLEATTHISTIME; COMMITTING TOTHEPROPOSED SITE FOR PERMANENT REGIONAL PUBLIC PARK AND RECREATIONAL USES; AND AUTHORIZING THE CITY MANAGER TO ACT ON THE CITY'S BEHALF IN ALL MATTERS RELATED TO THIS PROGRAM AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The Texas Legislature has approved the Texas Recreation and Parks Account Regional Parks Program (the "Program") for the purpose of assisting political subdivisions of the State of Texas in acquiring land for public parks. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. Program. The City certifies that it is eligible to receive assistance under the PART 2. The City Manager is authorized to make application to the Texas parks and Wildlife Department concerning the site to be known as the City of San Marcos Regional Park Preserve, Phase I for use as a park site and that this site will be dedicated, upon completion of the proposed acquisition for public park and recreation purposes in perpetuity. PART 3. The City certifies that its match of 50 percent of the funds required for this acquisition is available at this time. PART 4. The City Manager, Larry D. Gilley, is authorized to execute and submit this grant application and all related documents on the City's behalf and to act in all matters related to this Program. PART 5. This Resolution shall be in full force and effect immediately from and after its passage. ADOPTED this the 22nd day of January ,2001.
