OWEN, JOHN E. McBRIDE, AND THOMAS TIERNEY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />18. <br /> <br />RECITALS: <br /> <br />1. On October 24, 2000, the City Planning and Zoning Commission conducted a <br />public hearing on the proposed abandonment of the alleyway between the 1400 blocks of <br />Perkins and Nevada Streets adjacent to Lots 193 through 196 and Lots 197 through 200 <br />of the Z. Williamson Third Addition, and voted unanimously to approve the proposal, <br />subject to the City's reservation of a public utility easement for the entire alleyway. <br /> <br />2. The City Council conducted a public hearing regarding this abandonment on <br />January 8 , 2001. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The abandonment of the alleyway between the 1400 blocks of Perkins <br />and Nevada Streets is approved, subject to the City's reservation of a public utility <br />easement for the entire alleyway. <br /> <br />SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />Quitclaim Deeds attached to this ordinance conveying to Walter D. Owen, John E. McBride <br />and Thomas J. Tierney, their pro-rata shares of the alleyway described above, without <br />cash consideration. <br /> <br />SECTION 3. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br />
